By downloading, installing, accessing, or utilizing the BENE social app (“the App”), you (“the User”) are deemed to have consented to be bound by the terms and conditions of this End User License Agreement (“this Agreement”). In the event that you do not concur with all the provisions of this Agreement, you must refrain from downloading, installing, accessing, or using the App.

1. Subject to the stipulations of this Agreement, the App proprietor grants the User a non-exclusive, non-transferable, and restricted license to install and employ the App on a single mobile device that is owned or controlled by the User for personal and non-commercial purposes.

2. The User is prohibited from copying, modifying, distributing, selling, leasing, sublicensing, reverse engineering, decompiling, or making any attempts to uncover the source code of the App except as permitted by law.

3. The User must not remove, alter, or obscure any copyright, trademark, or other proprietary notifications on or within the App.

3. The User is solely accountable for the content they post, transmit, or store via the App. The User must ensure that such content does not infringe upon any third-party rights, including but not limited to copyright, trademark, privacy, or publicity rights.

5. The User may not interfere with the operation of the App or attempt to gain unauthorized access to the App's systems or networks.

1. The App and all intellectual property rights therein, including but not limited to copyrights, trademarks, patents, and trade secrets, are owned by the App owner or its licensors.

1. Under no circumstances shall the App owner be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or in connection with the User's use of the App.

2. The App owner's total liability to the User for all claims arising from or in connection with the User's use of the App shall not exceed the amount paid by the User for the App (if any).

3. The User acknowledges that the limitations of liability set forth in this Agreement are an essential basis of the bargain between the User and the App owner, and without such limitations, the App owner would not be able to provide the App on the terms specified in this Agreement.

The User agrees to indemnify and hold harmless the App owner, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with the User's use of the App, violation of this Agreement, or infringement of any third-party rights.

2. The User accesses and uses third-party content and websites at their own risk. The App owner shall not be liable for any damages or losses arising from the use of third-party content or websites.
